Back-to-school season heralds the arrival of Texas’ annual Sales Tax Holiday, an event held since 1999. This year’s holiday starts on Friday, August 9th, and ends at midnight on Sunday, August 11th. During this period, shoppers will not pay state or local sales tax on many school supplies, clothing, and shoes priced under $100. Lay-away plans are also eligible for the tax exemption.

The law exempts most clothing and footwear priced under $100 from sales and use taxes. Backpacks under $100 used by elementary and secondary students are also exempt. The exemption includes backpacks with wheels if they can be worn like a traditional backpack and messenger bags but excludes items classified as luggage, briefcases, athletic/duffle/gym bags, computer bags, purses, or framed backpacks.

Additionally, Texas families benefit from a sales tax break on most school supplies priced below $100 when purchased for use by elementary or secondary school students.

No exemption certificate is required for holiday purchases except when buying supplies under a business account. In such cases, the retailer must obtain an exemption certificate from the purchaser certifying that the items are for use by an elementary or secondary school student. "Under a business account" means using a business credit card or check instead of personal payment methods.

To assist families in planning their shopping during this period, the Comptroller’s website offers a list of tax-free items available online at Sales Tax Holiday.

For any questions regarding the annual Sales Tax Holiday, contact either my Capitol or District office. It is a busy time for parents; thus my offices are available to assist with any inquiries or concerns. Feel free to reach out if you have questions about Texas state agencies or require constituent services assistance (Capitol Office: 512-463-0672; District Office: 361-949-4603).
